The Clarity Act, the sweeping bill that would set the ground rules for U.S. crypto markets, is running out of time and votes, with Senate leadership now signaling that the chamber is unlikely to be cleared before lawmakers disperse for their August recess.

Senate Majority Leader John Thune told reporters on Thursday that he does not expect the digital assets market structure bill to gain sufficient traction before the summer recess, although he said he still hopes to begin the floor process in advance. Missing that window is a serious setback: with midterm campaigns set to dominate the fall, dragging the vote into September significantly reduces its chances of becoming law this year.

The immediate obstacle is ethics. Republicans on Wednesday released an updated 616-page text that would ban federal officials, including the president, from issuing or sponsoring digital assets, leaving enforcement solely to the Justice Department. Democrats whose votes are needed to reach the 60-vote threshold rejected the proposal.

Senator Ruben Gallego, one of only two Democrats to support the bill in committee, told Politics The GOP offer was not a serious effort after months of bipartisan work, promising to return counter-language. Gallego is now working with Senator Thom Tillis, who called the White House-backed package a step in the right direction but made his support conditional on stronger guardrails against officials profiting from crypto.

Trickier issues concern the ongoing debate over so-called stable currency yield — the practice of crypto platforms like Coinbase offering rewards to customers for holding dollar-based tokens in accounts — and the ongoing battle to curb conflicts of interest among government officials, especially President Donald Trump and his many crypto ventures.

As the clock ticks down, the chances of the crypto industry getting its long-awaited market structure bill are becoming increasingly slim.

Forecast markets and analysts have become gloomier. Galaxy Research, which has steadily revised its forecast as the calendar tightens, now frames passage because this requires a last-ditch effort, while the betting odds are well below even.

Further complicating the timeline, Sen. Lindsey Graham’s funeral, which is expected to draw many Senate Republicans early next week, could throw off the schedule and make the timing of any procedural vote uncertain.
